In light of the U.S. Supreme Court’s landmark decision, Texas Department of Housing and Community Affairs v. The Inclusive Communities Project, the U.S. Department of Housing and Urban Development’s Office of General Counsel published guidance on April 4 urging housing providers and owners to consider applicants with a criminal background on a case-by-case basis. The guidance directs housing providers to avoid having a blanket policy that denies housing to people with a criminal history.  Many real estate managers have expressed concern with how to comply with the guidance and also apply common sense policies when screening potential tenants.
